Status: A compliance audit was ordered on the campaign of Councillor Giorgio Mammoliti. Councillor Mammoliti appealed that order and subsequently withdrew his appeal. An audit is presently being conducted, and it is expected that audit will be completed in the late-fall 2012 or early-winter 2013.
Fair Elections Toronto’s allegations against Councillor Giorgio Mammoliti include the following contraventions of the Municipal Elections Act:
- Councillor Mammoliti is believed to have under-reported his campaign expenses by approximately $5,800. When added to the expenses disclosed by his campaign, Councillor Mammoliti would have exceeded his spending limit
- Councillor Mammoliti, it is alleged, did not declare the fair market value of his campaign office at 2958 Islington Avenue as an expense of or as a contribution to his campaign. This results in a number of apparent contraventions of the Act, including sections 69(1)(d), 69(1)(e), 78, 71(1) and 76(4);
- In contravention of section 71(1) of the Act, it is alleged that Councillor Mammoliti received and did not refund a contribution in excess of the legal contribution limit of $750; and
- It is alleged that the so-called fundraising event that Councillor Mammoliti disclosed without a name or date is not, in fact, a bona fide fundraising event according to the definition of the Act and as such Councillor Mammoliti’s campaign exceeded its spending limit by a further $17,196.94.
